Over the year end, in quick succession two red state judges (first Utah, then Oklahoma) ruled that state bans on same - sex marriage were in conflict with the US constitution, and so struck down those bans. Since then, both rulings have had stays placed on their execution, but meanwhile, there've been a series of further notable decisions in other red and purple states, some in just the past week. Individually, each of these is less dramatic than the Utah and Oklahoma decisions, but collectively they are impressive, and reinforce the impression that the writing is now on the wall for gay marriage bans, even in red states.</div>

The ACLU, on behalf of gay couples throughout Missouri, plans to sue this week for recognition of same-sex marriage.<br />
<br />
Stephanie Perkins, deputy director for PROMO, a Missouri gay and lesbian advocacy group, said the litigation seeks to overturn Missouri’s ban on same-sex marriage.<br />
<br />
Couples from Kansas City, St. Louis, mid-Missouri and Springfield are included in the suit, which will be filed in state court in Kansas City.<br />
<br />
Charles Abernathy, spokesman for the GLO Center in Springfield, said a news conference involving the ACLU litigation has been scheduled at the GLO Center for Wednesday.<br />
<br />
Abernathy said that while GLO will be the venue, PROMO is taking the lead on the event.<br />
<br />
The litigation comes less than a month after a federal judge struck down Oklahoma’s ban on same-sex marriage.<br />
<br />
The ban is similar to Missouri’s prohibition on same-sex marriage.
Missouri voters approved the ban in 2004 — 71 percent to 29 percent — the same year Oklahoma approved its ban. The bans in both states are amendments to the state constitutions.<br />

Step by step, queer families are seeing moves to full recognition, even in American red states (and in church). The latest in victory in Idaho follows court decisions in Utah and Oklahoma to strike down the states' constitutional ban on gay marriage, and the decision by Nevada's Republican governor not to defend his state's ban. A challenge to the <a href="http://kxan.com/2014/02/10/austin-couple-challenges-texas-gay-marriage-ban/" target="_blank">gay marriage ban in Texas is in court</a> this week, and court challenges under way in a further 19 states.</div>

<strong>Idaho's top court grants adoptive rights to spouse in gay marriage </strong></h3>

Idaho's top court on Monday ruled that state law allows a woman to adopt the children of her same-sex spouse, in a precedent-setting victory for gay couples in a socially conservative U.S. state that has banned the unions.</div>

The woman, unidentified in court documents on confidentiality grounds related to adoption, sought to share parental rights with her long-term partner. She appealed a magistrate judge's rejection of her petition.</div>

The Idaho Supreme Court, in a unanimous decision reversing the lower court's ruling, said a person's gender or sexual orientation was not part of the legal criteria that allowed a minor to be adopted by an in-state adult resident.</div>

"Any adult person" is defined as any human being over the age of 18 and "cannot possibly be construed to mean 'any married adult person' as the magistrate ultimately determined," Idaho Supreme Court Justice Jim Jones wrote for the court.</div>

Four legally married gay couples filed a federal civil rights lawsuit Monday seeking a court order to force Ohio to recognize same-sex marriages on birth certificates despite a statewide ban, echoing arguments in a similar successful lawsuit concerning death certificates.
The couples filed the suit in federal court in Cincinnati, arguing that the state's practice of listing only one partner in a gay marriage as a parent on birth certificates violates the U.S. Constitution. </div>

"We want to be afforded the same benefits and rights as every other citizen of the United States," said one of the plaintiffs, Joe Vitale, 45, who lives in Manhattan with his husband and their adopted 10-month-old son, who was born in Ohio. The pair married in 2011 shortly after New York legalized gay marriage.
Rob Nichols, a spokesman for Republican Gov. John Kasich, said his office doesn't comment on pending litigation, "except to say that the governor believes marriage is between a man and a woman."
The other plaintiffs in Monday's lawsuit are three lesbian couples living in the Cincinnati area who married in states that have legalized gay marriage. One woman in each of those marriages is pregnant through artificial insemination, and their babies all are due to be born this summer in Cincinnati hospitals.
The couples say they're worried that having only one of them listed as a parent on their children's birth certificates could lead to problems down the road, such as a denial of parental rights to the one not named should their partner die or experience a medical emergency.
"I have no legal grounds to stand on. That's not something that should be happening in our society," said Pam Yorksmith, who married her wife in California in 2008. The couple has a 3-year-old son and another on the way.
The couples' attorney is the same one who represented two gay married couples in their lawsuit last year that successfully sought a court order forcing Ohio to recognize same-sex marriages on death certificates. The state is appealing the ruling, issued in December by federal Judge Timothy Black.
"At both ends of our lifespans, a marriage is a marriage. A family is a family," said the couples' lawyer, Cincinnati civil rights attorney Al Gerhardstein. "A family is a loving, nurturing group of people and the identification document when the children come along is the birth certificate, and it ought to be right."<br />

Austin couple Cleopatra DeLeon and Nicole Dimetman will be traveling to San Antonio for the case this week.They married in 2009. “We decided that it was the right thing to do and that it was the right thing to do for our son,” said Dimetman. “I think that, whatever happens — I think Nicole and I will feel like we’ve kind of pushed the ball forward for people like us,” DeLeon said. DeLeon and Dimetman got married in Massachusetts. When they returned home to Texas, the state didn’t recognize the marriage. That means — in the states eyes — they didn’t have the same parental rights, medical rights, or rights after death as heterosexual married couples. The motion for injunction states that Texas Constitutional amendment and policies violate “the Due Process and Equal Protection Clauses of the Fourteenth Amendment”. DeLeon and Dimetman think of what a win for them would mean for their son. “He would never have to grow up feeling like the state of Texas didn’t protect our family,” said DeLeon. “I think it’s important to note that this issue has moved very quickly since 2005,” Dimetman said.</span></div>

The High Court of Justice on Tuesday night, by a split 5-2 vote, ordered the state to recognize the gay adoption of a child born through surrogacy, including registering both the biological father and his partner as fathers of the child.
Simultaneously, the High Court rejected 7-0 the request of another gay couple for recognition of their right to gay adoption.

The new law provides gay and lesbian couples with such legal protections and responsibilities as the ability to take family leave to care for a partner, to make medical and end-of-life decisions for a partner, to live together in a nursing home, and to adopt children together.<br />
During his annual State of the State address in January, Hickenlooper challenged the state legislature to move forward by saying: 'This year, let's do it. Let's pass civil unions!'<br />
He had also publicly supported civil unions during his address a year earlier.<br />
The law takes effect May 1.<br />
It was just seven years ago that the state voted to constitutionally ban same-sex marriage. It will join eight states that have civil unions or similar laws. Nine states and the District of Columbia allow gay marriage.<br />
Among those present at the signing was Colorado House Speaker Mark Ferrandino, a gay Denver Democrat who backed the bill.<br />
'With the Governor’s signature here today, the protection of Colorado’s laws will now extend equally to all,' Ferrandino said in a statement. Thousands of Colorado families will now be able to receive the recognition they deserve.'<br />
He added: 'Ladies and gentlemen, the Colorado sun now warms all our people.<br />

Murray, who is currently a fellow at the American Enterprise Institute, is revered by many conservatives. (He considers himself a libertarian.) His 1984 book “Losing Ground,” which blamed social programs for worsening poverty, and his 1994 book, “The Bell Curve,” which ascribed lower I.Q. scores to some minorities, have been attacked by liberals but embraced as game-changers by many conservatives.</div>

As he got warmed up, Murray explained that, while driving for more than an hour that morning to the conference, he had begun talking out loud to himself, which is how he usually practices his speeches. Upon realizing that he had more than an hour’s worth of fresh thoughts, he decided to simply drop the planned ones. The question on his mind was “How can conservatives make their case after the election?,” and the answer he wanted to share was drawn from his experience with his own four children. They range in age, he said, from twenty-three to forty-three. While they share many of his views on limiting the size of government, and supporting free enterprise, he said, “Not one of them thought of voting for a Republican President” in the last election. Their disenchantment with the Republican Party was not specifically because of Mitt Romney, he added, but because, “They consider the Party to be run by anti-abortion, anti-gay, religious nuts.”</div>

Certainly the locomotive power of the issue seemed hard to miss on a day when the top political news was Ohio Republican Senator Rob Portman’s announcement that he, too, supports gay marriage. (<a href="http://www.newyorker.com/online/blogs/newsdesk/2013/03/rob-portman-and-his-brave-gay-son.html" style="color: black; outline: 0px; text-decoration: none;">Richard Socarides has more on that</a>.) While Portman’s position shifted because of his family situation—he explained publicly for the first time that his son had come out as gay—Murray said his own views had been influenced heavily by friends. “I was dead-set against gay marriage when it was first broached,” Murray said; as a fan of Edmund Burke, he regarded marriage as an ancient and indispensable cultural institution that “we shouldn’t mess with.” He used to agree with his friend Irving Kristol, the late father of neo-conservatism, that gay people wouldn’t like marriage. “ ‘Let them have it,’ ” he recounted Kristol as saying, with a chuckle. “ ‘They wont like it.’ ” Murray said that he himself used to think that “All they want is the wedding, and the party, and the honeymoon—but not this long thing we call marriage.”</div>

But since then, Murray said, “we have acquired a number of gay and lesbian friends,” and to what he jokingly called his “dismay” as a “confident” social scientist, he learned he’d been wrong. He’d been especially influenced by the pro-gay-marriage arguments made by Jonathan Rausch, an openly gay writer for the <em>National Journal</em> and the <em>Atlantic</em>. Further, Murray said, he had discovered that the gay couples he knew with children were not just responsible parents; they were “excruciatingly responsible parents.”</div>

MPs have tabled new amendments to gay marriage legislation currently going through Parliament to give straight couples the same rights as homosexual ones. </div>

Researchers found that gay and lesbian parents are at least as good at coping with the demands of parenting. Children do not suffer any disadvantage, and the vast majority are not bullied at school, but the report warns: "Bullying and teasing are much more of a problem in secondary schools than primary schools; thus, only follow-up will reveal how things turn out in the future."</div>

The experiences of 130 gay, lesbian and heterosexual adoptive families in Britain, with children aged four to eight, were examined – focusing on the quality of family relationships, how parents cope and how children adjust. Family life and the quality of relationships are very similar for children regardless of their parents' sexual orientation, it says.</div>

Kansas state supreme court made a landmark ruling that same-sex couples are to be allowed to adopt. </div>
<div align="justify">
In addition it ruled that when a same-sex couple has a child together, both parents can be fully recognized as parents under Kansas state law. </div>
<div align="justify">
The court explained that Kansas parentage laws apply equally to women and non-biological parents, and that courts must consider the reality of who a child’s parents are in order to protect the interests of children. </div>
<div align="justify">
With this ruling, Kansas joins a number of other US states in ruling that when two people bring a child into the world and then raise that child as co-parents, the law should treat both of them as the child’s parents, regardless of gender or biology. </div>
<div align="justify">
The ruling was delivered on Friday (22 February) over a case of two women, Marci Frazier and Kelly Goudschaal, who had been raising children together, but then faced a custody dispute after they separated. </div>
<div align="justify">
The court ruled that the coparenting contract the couple had signed is valid and should be recognized, as their children are better off having two parents than just one: </div>
<div align="justify">
'To summarize, the coparenting agreement before us cannot be construed as a prohibited sale of the children because the biological mother retains her parental duties and responsibilities. </div>
<div align="justify">
'The agreement is not injurious to the public because it provides the children with the resources of two persons, rather than leaving them as the fatherless children of an artificially inseminated mother. No societal interest has been harmed; no mischief has been done. </div>
<div align="justify">
'Like the contract in Shirk, the coparenting agreement here contains “no element of immorality or illegality and did not violate public policy,” but rather “the contract was for the advantage and welfare of the child[ren]'. </div>
<div align="justify">
LGBT rights organizations welcomed the ruling across the state. </div>
